Lexmark is an American corporation. The company is a developer, manufacturer and supplier of printing and imaging solutions, including laser and inkjet printers, multifunction products and associated supplies and services for business and individual consumers worldwide. Lexmark was founded in 1991 as a spin-off of technology corporation IBM's printer-manufacturing division. Lexmark became publicly held and traded in 1995. The company has more than 13,000 employees worldwide. Lexmark is a Fortune 500 company and had $5.3 billion in revenues in 2004.
Lexmark's Optra series laser printers are widely used in business applications, and its all-in-one models are extremely popular. Lexmark took over production of the IBM Model M Keyboard in the mid 1990s. The patent was sold several years later to Unicomp.
ACRA v. Lexmark
A court victory in 2005 was handed to Lexmark in the case of ACRA v. Lexmark. This case states that Lexmark can enforce the “single use only” policy written on the side of Lexmark printer cartridge boxes sold to certain large customers at a discount, with the understanding that the customers will return the cartridges to Lexmark after using them. This means that these customers can face lawsuits if they breach the agreements, and do not return the cartridges.
Lexmark v. Static Control Components Inc.
Also in 2005, the US Supreme Court rejected Lexmark's petition for a writ of certiorari, thereby rejecting their attempt to have the Court hear their DMCA case.
